These Terms & Conditions (also referred to as our Terms of Service) govern use of the ChatWay website, web application, software platform, APIs and services provided by CHATWAY IT SOLUTIONS PRIVATE LIMITED. Please read them carefully before using our services.
1. Acceptance of Terms
By accessing or using ChatWay’s services, you agree to these terms and applicable laws and regulations. If you do not agree, you should not use the services. These terms apply to visitors, users and business customers. If you act for a business, you must be authorized to accept these terms on its behalf.
2. Service Description and Third-Party Platforms
ChatWay provides software and technology services for supported business messaging integrations, including the WhatsApp Business Platform and supported Meta services, customer management, CRM, shared team inbox, message templates, automation, chatbot tools, customer support, reporting and related API and webhook functionality.
Available features depend on the service configuration, customer authorization and applicable third-party permissions. WhatsApp and Meta are third-party platforms and trademarks and are not owned by ChatWay. Integration descriptions do not represent that ChatWay is endorsed by or holds any partnership status with Meta or WhatsApp.
Third-party services may be subject to their own terms, policies, pricing, approval processes and restrictions. Their availability and operation are outside ChatWay’s control.
3. User Obligations and Messaging Compliance
Customers and users must:
- Provide accurate, current and complete account and business information.
- Safeguard account access, passwords and credentials, and manage authorized team access responsibly.
- Have a lawful basis for processing customer information and obtain required consent or messaging opt-ins.
- Respect opt-out requests and use approved message templates where required.
- Comply with applicable laws, data privacy and anti-spam requirements, and applicable Meta and WhatsApp messaging platform policies.
- Avoid spam, unauthorized messaging, unlawful content and unauthorized access to accounts or data.
- Not reverse engineer or disrupt the services except where applicable law expressly permits an activity that cannot be restricted by contract.
Customers remain responsible for the content, contacts, instructions and campaigns they submit or authorize. ChatWay does not offer a policy bypass, unrestricted messaging or protection from platform enforcement. Message delivery, template approval and uninterrupted third-party account access are not guaranteed.
ChatWay does not ask customers for their Facebook password. Use official authorization and onboarding processes where available and do not publicly disclose access tokens or API credentials.
4. Payment Terms
You agree to pay the fees associated with your selected subscription or service arrangement and maintain valid payment information where applicable. The applicable pricing, billing terms and payment methods are those presented for your selected service or otherwise agreed with you.
Payments are non-refundable except as required by law or explicitly stated in applicable refund terms provided for your purchase. We may change pricing with reasonable notice to affected customers, subject to applicable law and agreements.
Payment processing may be governed by the payment processor’s own terms and privacy policy.
5. Intellectual Property
The service and its original software, features and content belong to CHATWAY IT SOLUTIONS PRIVATE LIMITED or its licensors. Subject to these terms and your applicable service arrangement, you may use the service for authorized business purposes.
You may not copy, modify, distribute, sell or lease our software or proprietary content, or attempt to extract its source code, unless applicable law permits it or we provide written permission. Third-party trademarks and materials remain the property of their respective owners. You retain your rights in information and content you provide and authorize us to process it as necessary to provide the requested services.
6. Privacy and Customer Data
Our Privacy Policy explains how we process information across the website, application, software platform, APIs and services. Customers are responsible for lawful collection and use of the information they submit, and for providing required notices and permissions.
You may request account and associated personal information deletion by following our Data Deletion Instructions or emailing hello@chatway.info. Verification and legitimate retention requirements may apply.
7. Service Availability and Limitations
We use reasonable efforts to maintain the services, but availability may be affected by maintenance, technical issues, network conditions, third-party platform changes or events outside our control. No system is completely secure and no promise of uninterrupted or error-free service is made.
To the extent permitted by applicable law, the services are provided on an “as is” and “as available” basis. Nothing in these terms excludes rights or obligations that cannot lawfully be excluded.
8. Suspension and Termination
We may restrict, suspend or terminate access where reasonably necessary due to violation of these terms, applicable law or platform policies, non-payment, security risks or misuse. Notice will be provided where appropriate and legally required.
You may contact us about account closure. Closure and data deletion are subject to applicable payment, contractual and legitimate retention obligations. Provisions that by their nature should survive termination, including accrued payment obligations and intellectual property protections, continue to apply.
9. Responsibility and Liability
Customers are responsible for authorized use of their accounts and the lawfulness of their data and messages. To the extent permitted by applicable law, ChatWay is not responsible for third-party platform decisions, message delivery failures outside its control, or indirect or consequential losses arising from use of the services. These terms do not exclude or limit liability where doing so would be unlawful.
10. Changes to These Terms
We may update these terms to reflect changes in our services, applicable requirements or practices. Updates will be published on this page with a revised “Last Updated” date. Additional notice will be provided where required by law or an applicable agreement.
